Agreement Overview:
Polar Blades Rental Return Policy
POLAR BLADES agrees to lease certain equipment, to the Customer (as specified in the attached Quote or Contract). The Customer agrees to rent the Equipment from Polar Blades under the terms set forth in this Agreement, which includes both the Quote or Contract and the following conditions.
Entire Agreement: This Agreement, including any related Quote, Contract, or Invoice, constitutes the entire agreement between Polar Blades and the Customer, superseding all prior agreements.
Rental Fee: The Customer agrees to pay Polar Blades the Rental Fee, applicable taxes, shipping cost and a late return fee of $25 per hour and any additional charges.
Rental Period: The Rental Period, which includes the transportation time plus the duration Equipment is in the Customer’s possession. The Rental Period continues until the Equipment is either returned to Polar Blades or made available for return under terms acceptable to Polar Blades
Calculation of Rental Fee: Rental Fees accrue daily, including weekends and holidays, Monthly fees are calculated based on a 28-day month.
Cancellation Policy: The Customer may cancel this Agreement by providing written notice to Polar Blades up to 24 hours before the Rental Period begins. Late notice of cancellation will incur additional charge.
Payment: Payments are due within 30 days of Polar Blades’s invoice Additional interest may apply for overdue accounts.
Risk: The Customer bears all risk and liability for damage or loss of the Equipment until it is returned to Polar Blades. The Customer must pay for any damage or loss immediately upon demand.
The Customer will still be responsible for::
The difference between 10% of the loss value and the damage waiver cost.
Loss or damage from overloading, electrical issues, theft, or breach of the Agreement.
The Customer must also assign any insurance recovery rights to Polar Blades
Repairs or Replacement: If the Equipment malfunctions, the Customer must stop using it and notify Polar Blades . Polar Blades may repair or replace the Equipment at its discretion. The Customer is responsible for repair costs due to misuse or breach of the Agreement and must continue to pay Rental Fees during repair periods.
- Use and Care: While in possession of the Equipment, the Customer must:
Not remove or alter any identification marks on the Equipment.
Avoid adding any new markings or symbols.
Operate the Equipment responsibly, avoiding abuse or misuse.
Protect the Equipment from weather with suitable coverings.
Follow Polar Blades’s and the Equipment manufacturer’s instructions.
Use the Equipment only for its intended purpose.
Allow Polar Blades access for regular maintenance and inspections as needed.
Site of Use: The Equipment must remain at the Site (as defined in the contract or shipping order) during the Rental Period. The Customer must obtain prior written consent from Polar Blades before moving the Equipment from the Site.
Transportation Costs: The Customer is responsible for all costs related to transporting the Equipment.
Indemnity: The Customer agrees to indemnify Polar Blades against any losses, damages, or expenses related to injury or property damage arising from the Equipment’s use.
Compliance with Laws: The Customer must comply with all applicable laws and regulations related to the Equipment and its use, and indemnify Polar Blades for any losses resulting from non-compliance. The Customer is solely responsible for obtaining necessary permits and licenses.
Termination: Polar Blades may terminate the Agreement without notice if the Customer fails to pay rent, becomes bankrupt, breaches the Agreement, or if the Equipment is seized. Polar Blades can reclaim the Equipment and recover all due rent and damages. The Customer is liable for all legal fees incurred in enforcing the Agreement.
Validity: If any part of this Agreement is found invalid, the remaining terms remain in effect. Polar Blades may terminate the Agreement at any time and demand return of the Equipment and payment of all rental charges.
Out of Control: Polar Blades is not liable for delays or failures in delivery or performance due to events beyond its control, including natural disasters, strikes, or other unforeseeable circumstances.
Representation: Polar Blades warrants that the Equipment is in good working order but is not responsible for its suitability for any specific use.
This Agreement, which does not constitute a purchase and sale agreement for the Equipment, outlines all terms and conditions in the Quote or Contract, with the final amount reflected in the Invoice at the end of the Rental Period unless otherwise approved in writing, and it benefits and binds the parties and their successors and permitted assigns.
